Terms and Conditions
The terms governing access to and use of WebMarket.
Effective date: 6 September 2026
These Terms and Conditions ("Terms") govern the WebMarket website, WebMarket mobile application, and related products and services operated by Pacific Tech Ltd ("Pacific Tech", "we", "us", or "our"). By accessing or using WebMarket, you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility and accounts
You must be legally capable of entering a binding agreement and provide accurate, current information. You are responsible for safeguarding your password, access tokens, and account and for activity performed through your credentials. Notify us promptly of suspected unauthorised use.
2. WebMarket services
WebMarket may display and provide ready-made websites, software templates, Laravel systems, licences, digital downloads, website-development services, expansion services, technical support, quotations, subscriptions, and related professional services. Product descriptions identify the specific scope, deliverables, licence, and availability applicable to an order.
3. Orders, prices, and payment
- Prices, taxes, fees, currencies, and available payment methods are shown during checkout or in a written quotation.
- An order is accepted only when payment is confirmed or we expressly accept the order in writing.
- You authorise the selected payment provider to process the transaction and agree to its applicable terms.
- We may correct obvious pricing or listing errors before fulfilment and will offer an appropriate refund where payment was already made.
- You are responsible for accurate billing, contact, domain, hosting, and project information.
4. Digital products and licences
Digital products are licensed, not sold, unless a product description or written agreement expressly transfers ownership. You may use a product only within the stated licence. Unless expressly permitted, you must not resell, redistribute, sublicense, publish source files for download, remove ownership notices, bypass access controls, or use a product unlawfully.
5. Custom and professional services
Custom work is governed by the accepted quotation, proposal, statement of work, or service agreement. You must provide timely content, access, approvals, and feedback. Deadlines may change where dependencies, requirements, approvals, or client-supplied materials are delayed or changed. Additional or changed requirements may require revised pricing and delivery dates.
6. Client materials and third-party assets
You represent that you have the rights needed for materials you provide. You grant us a limited licence to use those materials to perform the service. Third-party themes, plugins, fonts, images, APIs, hosting, domains, payment services, or other components remain subject to their own terms, licences, availability, and fees.
7. Refunds and cancellations
Refund eligibility depends on the product description, refund policy, applicable law, download or licence status, and work already performed. Because digital files can be delivered immediately, completed downloads or activated licences may be non-refundable except where defective, materially misdescribed, required by law, or otherwise stated in writing. Custom-service deposits and completed milestones may be non-refundable to the extent stated in the accepted proposal.
8. Acceptable use
You must not:
- violate law, intellectual-property, privacy, contractual, or other rights;
- upload malware, interfere with security, scrape without permission, or disrupt the service;
- attempt unauthorised access, credential sharing, fraud, chargeback abuse, or licence circumvention;
- use WebMarket or its AI features to generate or facilitate unlawful, harmful, deceptive, or abusive activity; or
- misrepresent identity, affiliation, ownership, or authority.
9. AI assistant
AI-generated responses may be incomplete, inaccurate, or unsuitable for a particular purpose. They are provided for general sales and product assistance and are not legal, financial, medical, or other professional advice. Verify important information before relying on it. Do not submit confidential, highly sensitive, or unlawful information.
10. Intellectual property
WebMarket, its branding, platform, original content, and technology are owned by or licensed to Pacific Tech Ltd and protected by applicable laws. No right is granted except the limited right to use WebMarket and purchased products under these Terms and the applicable licence.
11. Availability, updates, and support
We may maintain, update, suspend, modify, or discontinue features. We do not guarantee uninterrupted or error-free availability. Support scope and response times depend on the purchased plan, product, or agreement. Keep appropriate backups before installing or modifying digital products.
12. Account suspension and termination
We may restrict or terminate access for material breach, fraud, security risk, unlawful use, non-payment, or harm to WebMarket or others. You may sign out or permanently delete your account from My WebMarket > Delete Account in the mobile app. Deletion does not cancel obligations already incurred or require deletion of records we must retain by law.
13. Disclaimers
To the maximum extent permitted by law, WebMarket and standard digital products are provided "as is" and "as available". We disclaim implied warranties except those that cannot lawfully be excluded. We do not guarantee that a product will meet unstated requirements or that third-party services will remain available or unchanged.
14. Limitation of liability
To the maximum extent permitted by law, Pacific Tech Ltd will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, lost profits, lost data, or loss arising from third-party services. Our aggregate liability relating to a claim will not exceed the amount paid to us for the specific product or service giving rise to the claim during the preceding twelve months. Nothing excludes liability that cannot lawfully be excluded.
15. Indemnity
To the extent permitted by law, you agree to indemnify Pacific Tech Ltd against third-party claims, losses, and reasonable costs arising from your unlawful use, breach of these Terms, or materials you provide, except to the extent caused by our own unlawful conduct.
16. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. The parties should first attempt in good faith to resolve disputes through written notice and negotiation. Subject to applicable consumer rights and mandatory law, unresolved disputes will be submitted to courts of competent jurisdiction in Nigeria.
17. Changes to these Terms
We may update these Terms to reflect changes in our services, business, or legal duties. The revised Terms take effect when published or on a later date stated in the update. Continued use after the effective date constitutes acceptance where permitted by law.
